Please read this Privacy Policy to learn more about how we at Telshur, Inc. (“Telshur”, “we”, “us”) collect, use, and safeguard your information when you use our suite of medical communication and collaboration technology products and services (the “Application”), the Telshur Mobile Application, or our other digital properties, products and services (collectively, with the Application, the “Services”). This Privacy Policy applies to information collected and processed when you access or use the Services as an end user. Note that this Privacy Policy does not apply to any patients of end users or their protected health information or to any third-party platforms or services, or any third-party services linked or accessible from our Services.
This Privacy Policy is governed by and part of our Terms of Use. You consent to the collection and use of all information as set forth in this Policy when you access or use our Services in any manner. If you do not agree with this Privacy Policy, do not provide us with any information and do not use the Services.
Telshur may update this Privacy Policy from time to time. Your continued use of the Services following an update is your consent to the most recent Privacy Policy. We will collect your consent to these changes to the extent required by applicable law. You can see when this Privacy Policy was last updated by checking the “last updated” date displayed at the top of this Privacy Policy.

1. What is “Personal Information”?
As used in this Privacy Policy, “Personal Information” means any information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household. Personal Information falls within certain categories, for example:
- Identifiers (e.g., name, email, telephone number, address, username);
- Sensitive Personal Information (e.g., health data; precise geolocation; racial or ethnic origin; religious beliefs; contents of messages when we are not the recipient; in some cases, information about a known child);
- Legally protected information (e.g., race, citizenship, marital status, sex);
- Employment-related information (e.g., current or past employment);
- Non-public educational information, including information protected under the Family Educational Rights and Privacy Act (20 U.S.C. § 1232g, 34 C.F.R. Part 99);
- Biometrics (e.g., DNA, face/voice prints, health data) and audio, electronic, visual, thermal, or olfactory information;
- Commercial information (e.g., products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies);
- Internet or other similar activity (e.g., browsing history; content interactions); and
- Inferences drawn from Personal Information to create a profile about preferences, characteristics, trends, predispositions, behavior, attitudes, intelligence, and aptitudes.
Information that is not protected as Personal Information includes publicly available information; aggregated information (meaning data summaries or reports with Personal Information removed); and anonymized information that cannot be linked back to an individual.
2. Notice to End-Users and Patients
Our Services are intended for use by healthcare entities or organizations who subscribe to our Services (“Subscribers”) and their employees, contractors, or affiliates granted access via the Subscriber’s agreement with Telshur (“End Users”). Additionally, a Subscriber may use Telshur in ways that include processing certain health data about the Subscriber’s patients (“Patients”). If you are an End User or a Patient, the Subscriber is the data controller of your Personal Information. Telshur is not responsible for the Subscriber’s privacy or security practices which may be different from ours. Your data privacy questions and requests should initially be submitted to your Subscriber, not Telshur.
This Privacy Policy does not apply to any protected health information or other data subject to protections under the Health Insurance Portability and Accountability Act of 1996 and its implementing regulations (“HIPAA”). Any data subject to HIPAA processed by Telshur is governed by a separate written agreement with the covered entity.
3. Children and Minors
The Services are intended for healthcare professionals only. Telshur will not knowingly collect or solicit Personal Information from anyone under the age of 18 or knowingly allow such persons to register to use the Services. If you are under 18, please do not use the Services or send any information about yourself to Telshur.
4. Telshur Collection and Use of Personal Information
Telshur collects Personal Information through End User registration and use of the Services, when Patient or End User Personal Information is input to the Services by a Subscriber, and automatically from End User’s interactions with the Services. Telshur collects and processes Personal Information as a Service Provider to Subscribers, with consent, and to achieve our legitimate interest of providing and improving the Services. The categories and sources of Personal Information collection and processing are detailed below:
- End User Registration and Use. When you register as an End User, the Services will collect identifiers like your name and work email and employment information like your job title, work address, and work contact information. The Services will collect any Personal Information an End User may input when using the Services, for example within documents managed on the Services or communications sent through the Services. We use this information to facilitate the Subscriber’s use of the Services and for our internal business purposes.
- Patient Health Data. Telshur provides Subscribers with a telehealth platform for care transitions, workflow optimization, and communication. Telshur will collect and process Patient health data that the Subscriber includes in its documentation and communications via the Services. Telshur only processes Patient health data as instructed by the Subscriber and, where the Subscriber is a covered entity under HIPAA, Telshur is a business associate to that Subscriber subject to a Business Associate Agreement. Patients should contact the Subscriber with any questions or concerns about the Subscriber’s use of the Services.
- Your Communications with Telshur. If you contact Telshur by email or otherwise, we will collect your name, email address, employment information (if necessary) and any Personal Information you choose to include in the communication. Telshur will use this information to respond to your inquiry and, in some cases, to improve the Services.
- End User Interactions with the Services. Telshur collects technical data from End User interactions with the Services related to the End User’s access time, session duration, and interactions with content and features on the Services. This data is used to create reports at the Subscriber, team, and individual level. These reports are made available to Subscribers as part of their access to and use of the Services or to government agencies as necessary or required. Telshur may also use this data to better understand how the Services are used and to develop and improve the Services.
- Automatic Collection of Technical Data. The Services use cookies, flash cookies, log files, and related technologies to automatically collect technical data from your interactions with the Services. Technical data may include some Personal Information. For example, we may collect your device ID and browser type, IP address, and session data about your content interactions on the Services. The Services also track modalities used, which End Users initiate and/or receive communications, and pace and timing of delivery of healthcare services. If you access the Services via our mobile application, we may also collect your mobile phone number, geolocation data, and usage activities logs. Additionally, emails you receive from Telshur may contain clear gifs or web beacons. We do not tie the information gathered by clear gifs to End User Personal Information.
Telshur uses this Personal Information to facilitate the Subscriber’s use of the Services, communicate with Subscribers and End Users about the Services, and for our internal operations like troubleshooting, diagnosing problems with servers, and data analysis. Telshur also reserves the right to use Personal Information collected through the Services to fulfill any purpose with appropriate consent, monitor compliance with our contracts, maintain the security of the Services, comply with legal obligations or protect our rights, or for internal testing, research, or product development. Telshur may also process Personal Information related to a business transition involving some or all of our company assets.
In each case, we only collect, use, retain, and disclose Personal Information as is adequate and relevant to the specific, express purposes described below or as reasonably necessary and proportionate to the purpose for which it was collected. We will not collect additional categories of Personal Information or use already collected Personal Information for purposes that are materially different, unrelated or not reasonably necessary or compatible with the original purpose without notice and consent to you as required by law.
5. Cookie Notice
Cookies are small text files downloaded and stored on your computer or mobile device when you visit or use an online platform. Cookies help the platform recognize your device, store your preferences, or perform certain functions for the platform. Telshur uses only first-party cookies, meaning Telshur develops and manages all cookies on the Application and our other Services. Our Services do not use any third-party cookies. As such, Telshur controls all of the data collected by those cookies and we do not share that data with anyone. Our cookies are used for essential functionality and security and, as such, opt-out is not available because the Services cannot function without these cookies. If we deploy non-essential cookies or third-party cookies in the future, we will update this Privacy Policy and we will provide you with mechanisms to opt-out of cookies that are non-essential.
6. Retention of Personal Information
Telshur will only retain Personal Information as long as is necessary to provide the Services to Subscribers or achieve our business goals. We will retain Personal Information on the Services for the period instructed by the Subscriber. Technical data collected through cookies and similar technologies will be retained for as little as a few minutes or up to 24 months. Data is securely deleted at the end of the retention period. Telshur reserves the right to retain data for longer periods as required by law or court order or if doing so is necessary for our business purposes.
7. Personal Information Disclosures
Telshur will only disclose Personal Information to third parties as described in this section, with your permission, or as required by law. In the preceding 12 months, we have disclosed Personal Information for a business purpose to the following third parties:
- To Subscribers. If you use Telshur as an End User via a Subscriber, your Subscriber will have access to the Personal Information you provide to Telshur. The Subscriber may use that Personal Information according to their own privacy practices. Please contact your Subscriber with any questions.
- As Instructed By A Subscriber. Telshur will disclose Patient Personal Information as instructed by a Subscriber in our role as a service provider or as a business associate if a Subscriber is a HIPAA covered entity. A Subscriber may instruct us to make such a disclosure to facilitate the Subscriber’s provision of healthcare or other services to the Patient, or for other business purposes. Disclosure of Personal Information protected by HIPAA is subject to our business associate agreement with the Client.
- Our Service Providers. Telshur relies on service providers like IT support, website and data hosting services, and payment processors to provide certain functions and features of the Services. We may disclose Personal Information to our service providers as needed to perform their contractual obligations to us. We prohibit our service providers from selling or disclosing that Personal Information, and we require all service providers to maintain confidentiality standards and appropriate technical and organizational measures to ensure the security of your Personal Information. Telshur’s list of sub-processors is available to Subscribers upon request.
- Law enforcement, and other governmental agencies, as permitted or required by law. For example, as a healthcare platform, Telshur is subject to requirements to disclose certain information in response to legal and regulatory requests. We may also be required by certain government agencies to produce records related to End User communications or activities on the Services. Telshur will coordinate with the applicable Subscriber in connection with legal or regulatory requirements to disclose information.
- Other third parties, as permitted by applicable law, for example: if we go through a business transition (e.g., merger, acquisition, or sale of a portion of our assets); to comply with a legal requirement or a court order; when we believe it is appropriate in order to take action regarding illegal activities or prevent fraud or harm to any person; to exercise or defend our legal claims; or for any other reason with your consent.
- In an aggregated, anonymized, or deidentified format. Personal Information that has been aggregated or deidentified is generally not covered by privacy laws. Telshur reserves the right to disclose aggregated, anonymized, or deidentified information with third parties without restriction.
8. Telshur Data Security
Telshur has implemented and maintains reasonable security measures to secure your Personal Information from accidental loss and unauthorized access, use, alteration, and disclosure. For example, where appropriate, when you enter sensitive information, we encrypt that information using secure socket layer technology. Our security measures are appropriate to the volume, scope, and nature of the Personal Information processed and designed to meet our duty of care with respect to your Personal Information. We use industry-standard internet security methods and technologies to prevent unauthorized access, maintain data accuracy, and ensure correct use of information. However, no method of transmission online is entirely secure. You are responsible for keeping your device access and login information confidential. You are also encouraged to install anti-virus and anti-malware Application on your devices and keep all Application updated to avoid security risks. We cannot guarantee the security of the information you submit via our Services while it is in transit over the Internet, and any such submission is at your own risk. If you suspect unauthorized access to your information, it is your responsibility to contact Telshur immediately.
9. Notice of Privacy Rights
In the United States, consumer privacy is governed by federal privacy laws covering specific industries or data uses and state privacy laws providing with general consumer privacy rights. This section provides informational notices for state privacy laws that require companies to inform consumers about their privacy rights (e.g., California, Colorado, Connecticut, Nevada, Utah, Virginia, and others). Residents of states offering these privacy protections (each a “Consumer”) can exercise their privacy rights by submitting a Privacy Request (see Section 10) to the Subscriber. Some of these laws may not apply to our Services, in which case these notices are offered as a courtesy to those Consumers.
- Right to Correct. You have the right to request that we correct inaccurate Personal Information about you on our systems. If you become aware that the Personal Information that we hold about you is incorrect, or if your information changes, please inform us and we will update our records.
- Right to Deletion. You have the right to request that we delete your Personal Information that we collected and retained, with certain exceptions. Telshur may permanently delete, deidentify, or aggregate the Personal Information in response to a request for deletion.
- Right to Access. You have the right to request confirmation that we have collected Personal Information about you and that we provide you with access to that Personal Information. If you submit an access request, we will provide you with copies of the requested pieces of Personal Information in a portable and readily usable format. Please note that Telshur may be prohibited by law from disclosing certain pieces of Personal Information, and we may be limited in the number or frequency of requests we must fulfill.
- Right to Disclosure. You may request that we disclose information to you about our collection and use of your Personal Information, such as: (a) the categories of Personal Information we have collected about you; (b) the categories of sources for the Personal Information we have collected about you; (c) our business purpose for collecting, using, processing, sharing or selling that Personal Information, as applicable; (d) the categories of third parties with whom we share that Personal Information; and (e) if we sold or shared your Personal Information under the CCPA, two separate lists stating: (i) sales or sharing, identifying the Personal Information categories that each category of recipient purchased; and (ii) disclosures for a business purpose, identifying the Personal Information categories that each category of recipient obtained. Certain laws may limit the number or frequency of requests we must fulfill.
- Limited Use and Disclosure of Sensitive Personal Information. You have the right to opt-out or limit our use of your sensitive Personal Information. Telshur may collect or receive Personal Information from you that qualifies as sensitive Personal Information under privacy laws. Telshur does not and will not disclose any sensitive Personal Information for the purpose of inferring characteristics about you or otherwise use your sensitive Personal Information without your consent. We only use this Personal Information to provide the Services and, where we process the Personal Information for a covered entity, in compliance with HIPAA controls. If this ever changes in the future, we will update this Privacy Policy and provide you with methods to opt-out or limit our use and disclosure of sensitive Personal Information.
- No Selling or Sharing Personal Information. Some states entitle consumers to opt out of the sale or sharing of Personal Information or targeted advertising practices. Telshur does not sell your Personal Information or share your Personal Information with third parties for cross-contextual behavioral advertising purposes. If this changes in the future, we will update this Privacy Policy and provide you with a method to opt-out.
- No Patient Profiling. You have the right to opt-out of automated profiling. Telshur does not process your Personal Information to evaluate, analyze, or predict your interests and preferences or otherwise use automated profiling to produce significant effects that concern you. If this changes in the future, we will update this Privacy Policy and provide you with a method to opt-out.
- Right to Nondiscrimination. We will not discriminate against you for exercising your privacy rights. For example, unless permitted by law we will not: (i) deny you goods or services; (ii) charge you different prices or rates for goods or services; (iii) provide you a different level or quality of goods or services; (iv) retaliate against you as an employee, applicant for employment, or independent contractor for exercising your privacy rights; or (v) suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services, because you exercised a right under applicable privacy laws.
- Health Data Rights. Some state laws entitle consumers to certain details about health data collected about them, including (i) confirmation of whether the entity collects, shares, or sells the consumer’s health data and access that data, including a list of all third parties and affiliates with whom the entity has shared or sold the health data and a method to contact those third parties, (ii) a method to withdraw consent related to use of health data, and (iii) the right to have their health data be deleted.
- Right to Disclosure of Marketing Information. California’s Shine the Light Act (Civil Code sections 1798.83-1798.84) entitles California residents to request certain disclosures regarding Personal Information sharing with affiliates and/or third parties for marketing purposes.
- HIPAA. To learn about your rights under HIPAA, please contact the Subscriber.
10. Your Privacy Controls
End Users and Patients can control their Personal Information on the Services as follows:
- Patient Personal Information. All Patient Personal Information on the Services is input by a Subscriber as the Patient’s healthcare provider. To access, correct, delete, or control that Personal Information, please contact the Subscriber that provided us with your Personal Information.
- End User Registration. Personal Information associated with an End User’s registration can be updated and managed by the End User logging in using their login credentials or by the Subscriber. The Subscriber is responsible for managing and maintaining up-to-date access credentials for its End Users. Please contact the Subscriber for more information.
- Emails. If you give us your email address, we may send you informational or support emails related to the Services. If you opt-in for promotional emails, we may send those as well. If you do not wish to receive emails from Telshur, you can unsubscribe or change your preferences via the links provided in the emails or send a request to contact@telshur.com. Note that if you opt-out of promotional emails, we may still send you non-promotional emails related to your use of the Services or our ongoing business relations.
- Device Settings. You can control the data we collect through cookies and related technologies by adjusting your device settings or your cookie preferences on our website.
- Do Not Track. Do Not Track signals are signals sent through a browser informing us that you do not want to be tracked. Currently, our systems do not recognize browser “do-not-track” requests.
- Privacy Requests. If you wish to exercise your rights under your applicable privacy laws, please contact the Subscriber that inputs your Personal Information to the Services. If you want to express concerns, revoke your consent, lodge a complaint, or request information, please contact contact@telshur.com. If we cannot respond to your inquiry directly, we will forward it to the appropriate Subscriber.
Note that Telshur can only assist with a privacy request when we have sufficient information to verify that the requester is the person or an authorized representative of the person about whom we have collected Personal Information, and to properly understand, evaluate, and respond to the request. We do not charge a fee to process or respond to a verifiable request unless we have legal grounds to do so. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request. We endeavor to respond to privacy requests in accordance with the requirements of the law applicable to your jurisdiction. If we do not fulfill your request within the legally required timeline, you can appeal our response by contacting contact@telshur.com.
11. Your Consent to Cross-Border Data Transfers
Telshur is a United States company that uses technical infrastructure in the United States. We design and market the Services for use by Subscribers and their End Users in the United States. Subscribers and End Users use the Services as part of the Subscriber’s privacy practices. If you access the Services from outside the United States or if you are a non-U.S. citizen who is a Patient of a Subscriber, please be aware that your Personal Information may be transferred to, processed, stored, and used in the United States or other jurisdictions. The laws and rules that protect your Personal Information in the country to which your information is transferred may be different from those of the country where you live. For example, if your information is in the United States, it may be accessed by government authorities under United States law. Telshur is not responsible for determining whether a Subscriber’s use of the Services or whether the input of a particular End User or Patient’s Personal Information complies with any law or regulation. By allowing us to collect Personal Information about you, you consent to the transfer and processing of your Personal Information as described in this section.
